The details of the Services to be rendered will be expressly outlined in a separate agreement, estimate, or work order, which shall form an integral part of these Terms.

1.2 Service Area: Our Services are primarily offered within the geographical boundaries of San Diego, California. Requests for Services outside this designated area may be subject to additional fees or surcharges, which will be disclosed prior to the commencement of work.

1.3 Third-Party Services: From time to time, we may recommend, engage, or collaborate with third-party vendors to fulfill specific aspects of the Services. San Diego Curb Painters expressly disclaims any liability for the actions, omissions, or performance of such third parties, including but not limited to their goods and services.

2. Payment Terms

2.1 Pricing: The pricing for our Services will be communicated in writing and agreed upon prior to the initiation of any work. Additional charges may apply for custom designs or specialized materials, and such charges will be disclosed in advance.

2.2 Payment: Payment for Services is due in full upon the completion of work unless an alternative arrangement has been explicitly documented and agreed upon in writing. San Diego Curb Painters accepts various payment methods, including but not limited to cash, credit cards, and other approved payment systems.

2.3 Refunds: Due to the bespoke nature of our Services, refunds will not be issued once the work has commenced unless a material defect attributable to our workmanship is identified and cannot be rectified through reasonable efforts.

3. Client Responsibilities

3.1 Permission: It is the sole responsibility of the Client to ensure that any and all necessary permissions, authorizations, or consents from property owners, homeowner associations (HOAs), or local authorities have been obtained prior to engaging our Services. Failure to secure such permissions does not absolve the Client of payment obligations.

3.2 Access: The Client must ensure that the designated service area is readily accessible, free of obstructions, and in suitable condition for the performance of the Services. San Diego Curb Painters is not liable for delays or additional costs resulting from inaccessible or unsuitable work areas.

3.3 Accuracy: Clients are responsible for providing precise and accurate information regarding address details and design preferences. Approval of mock-ups or designs must be provided before the commencement of work, and any errors arising from inaccurate Client-provided information are the sole responsibility of the Client.

4. Limitation of Liability

4.1 No Warranty: The Services provided by San Diego Curb Painters are rendered "as is" and without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While we endeavor to provide high-quality work, we do not guarantee that our Services will meet your specific expectations or requirements.

4.2 Damage: San Diego Curb Painters takes all reasonable precautions to protect your property during the performance of Services. However, we are not responsible for damages resulting from pre-existing conditions, unforeseen circumstances, or factors beyond our reasonable control.

4.3 Indemnification: The Client agrees to indemnify, defend, and hold harmless San Diego Curb Painters and its employees, contractors, and agents from any and all claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising from or related to the use of our Services.

4.4 Weather and Conditions: San Diego Curb Painters reserves the right to cancel, postpone, or reschedule any appointment due to adverse weather conditions, unsuitable painting surfaces, or any other factors that may compromise the quality of the Services. In such cases, Clients will be notified promptly and alternative arrangements will be proposed.

4.5 Post-Service Damages: San Diego Curb Painters is not liable for any damages, wear, or alterations to the painted surface that occur after the completion of the Services, including but not limited to damage caused by natural elements, human interference, or vehicle traffic.

5. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be exclusively brought in the courts located within San Diego County, California.

6. Amendments

San Diego Curb Painters reserves the right to revise, amend, or modify these Terms at any time without prior notice. Clients are encouraged to review the most current version of these Terms on our website periodically. Continued use of our Services after changes have been made constitutes acceptance of the revised Terms.
